We take the privacy of our website users very seriously and are committed to protecting the information users provide to us in connection with their use of our website. Furthermore, we are committed to protecting and using your information in accordance with applicable law.

 

Your personal data will be transferred to our associated companies and service providers, e.g. IT providers and others who are subject to our instructions and who help us provide the services to you. Through appropriate legal, technical and organizational measures as well as through a regular monitoring thereof we ensure compliance with the applicable data protection laws and an adequate level of data protection where personal data is transferred to service providers located outside the European Union and the European Economic Area. Involved service providers will only get access to those specific personal data that is required to fulfill their services. Which data do we collect?

 

Non-identified and non-identifiable information that you provide during the registration process or that is collected through the use of our Services ("Non-Personal Information"). For the avoidance of doubt, we would like to point out that we may transfer or disclose non-personal information to third parties or otherwise use it at our discretion.

Please note that our services allow social interactions (e.g., posting content, information, and comments publicly and chatting with other users). Please be advised that any content or data you provide in these areas may be read, collected, and used by others. We discourage posting or sharing information that you do not wish to make public. If you upload content to our digital assets or otherwise make it available as part of your use of a service, you do so at your own risk. We cannot control the actions of other users or members of the public with access to your data or content. You acknowledge and hereby agree that copies of your data may remain accessible even after it has been deleted from cached and archived pages or after a third party has made a copy/stored your content.

Cookies


When you visit our website, cookies are stored on the device you use to access our website. Such cookies enable us to recognize your browser and offer various personalized services.

Cookies are small text files (alphanumeric identifiers) that are stored on your terminal when you visit a webpage. The information stored is sent back to the respective servers during a repeat visit. We use first-party cookies and third-party cookies, which may either be session cookies or temporary cookies.

Once the browser session has ended, session cookies are automatically deleted from your hard drive. These cookies store a so-called session ID to assign various requests from your browser to a common session. We use this type of cookie for the shopping cart feature as well as for the user and license data. Temporary cookies are automatically deleted after a specified period of time, or after 36 months maximum. The feedback given by cookies to the servers concerned in various browser sessions enables us to recognize repeat visitors to our website or to maintain the language settings selected for multiple website visits. A connection to customer accounts (if any) and thus possible identification is only made if the "Remember Me" feature is selected during log-in so we may provide a personalized shopping experience.

The processing of data associated with the setting of the cookies required is based on our legitimate interest in providing the respective service requested (Art. 6 para. 1 lit. f) GDPR).

Third-party cookies are set by servers other than our servers, i.e., the website you visit. However, browsers do not render first-party cookies accessible across domains. When visiting our webpages or online shop, third-party cookies are used by some third party companies. A list of such third party companies and the third-party cookies they use is available here. Further details are provided below in this Privacy Policy. By using such cookies, also known as "tracking cookies", visits to various webpages can be assigned to a specific person. It is thus possible to get a good idea of the interests of this particular person and adapt the webpages accordingly (personalization, e.g., by providing customized advertisements).

We only set such third-party tracking cookies, provided you have given us your consent via our cookie settings (Art. 6 para. 1 lit. a) GDPR).

Furthermore, you may also configure your browser in the browser settings in such a way to object to the use of specific types of cookies or to block them from the outset. You may visit our webpages if you have blocked the setting of cookies or have not consented to them. However, we would like to point out that in this case you may not use our webpages to the full extent and may in particular not do any shopping by virtual shopping cart for technical reasons (see above).

Contact Form


Our contains information that enables a quick electronic contact to our enterprise, as well as direct communication with us, which also includes a general address of the so-called electronic mail (e-mail address). If a website user contacts us by e-mail or via a contact form, the personal data transmitted by the user are automatically stored. Such personal data transmitted on a voluntary basis by a user to us are stored for the purpose of processing or contacting the user.

YouTube


We embed YouTube videos on our webpages. Youtube.com is a video portal operated by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland ("YouTube"). When you watch a YouTube video embedded on our webpages, a connection to youtube.com is established. This connection is required to display the respective video on our webpages in your browser. Google is responsible for the processing of data and the setting of cookies by YouTube. Such processing is beyond our control.

 

It should be noted that YouTube records and processes at least the IP address of your terminal, the date and time at which you watched the video, and the webpage you visited. Furthermore, a connection to Google's DoubleClick advertising network is established. Google provides further information on Google Ads as well as on opt-out options here as well as here. If you are logged into YouTube when accessing our website, YouTube assigns the connection information to your YouTube account.

 

If you wish to prevent this, you have to either log out of YouTube before visiting our webpages or make the relevant settings in your YouTube account. We use this service in view of our legitimate interest (Art. 6 para. 1 lit. f) GDPR) in the user-friendly design of our website. SoundCloud


We have integrated components of the social network SoundCloud into our websites. SoundCloud is a service that qualifies as an audio platform, allowing users to share audio tracks, and also disseminate such data to other social networks. SoundCloud's operating company is SoundCloud Limited, Berners House, 47-48 Berners Street, London W1T 3NF, United Kingdom.

 

When you visit our website, a direct connection between your browser and the SoundCloud server will be established immediately after the plugin has been activated. As a result, SoundCloud will be notified that you have used your IP address to visit our site. If you click the "Like" button or the "Share" button while you are logged into your Sound Cloud user account, you can link the content of our websites to your SoundCloud profile and/or share the content. Consequently, SoundCloud will be able to allocate the visit to our website to your user account. We emphasize that we as the provider of the websites do not have any knowledge of the data transferred and the use of this data by SoundCloud.

 

We use SoundCloud on the basis of Art. 6 Sect. 1 lit. f GDPR. The website operator has a legitimate interest in attaining the highest level of visibility on social media. If you prefer not to have your visit to our websites allocated to your SoundCloud user account by SoundCloud, please log out of your SoundCloud user account before you activate content of the SoundCloud plugin.

Google Analytics


We use Google Analytics on our website. This is a web analysis tool provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland ("Google"). Google Analytics sets the aforementioned cookies to analyze how webpages are used. The information generated by cookies on the use of our web pages, including the shortened IP address, is transmitted to a Google server, which may be located in the US, and is stored there. We have mutually agreed with Google Ireland Limited on so-called standard contractual clauses for the transfer of data to the US, a copy of which is available on request. Google exclusively analyzes anonymized data by using the code extension "anonymizeIp" provided by Google to partially change and thus anonymize IP addresses for the processing of data as described hereunder.

The legal basis for the use of Google Analytics is your consent pursuant to Art. 6 para. 1 lit. a) GDPR. You may revoke your consent at any time with future effect by deleting the cookies in your browser or in the cookie settings.

You may generally block the use of Google Analytics in your web browser. To this end, you merely need to install the browser add-on to disable Google Analytics. It is available for download here.

Google Tag Manager


For reasons of transparency, please note that we use Google Tag Manager. Google Tag Manager does not collect personally identifiable information. The tag manager makes it easier for us to integrate and manage our tags. Tags are small code elements that are used to measure traffic and visitor behavior, capture the impact of online advertising and social channels, set up remarketing and target audience targeting, and test and optimize web pages. We use the Tag Manager for the Google Service “Google Analytics”. If you have it disabled, Google Tag Manager will consider this deactivation. Links to Third-Party Providers


We also provide links to third-party providers and to our website on Facebook, Instagram, YouTube, and Soundcloud. When clicking on the relevant icon (such as the Facebook button) at the top or bottom of our website you will be redirected accordingly. We are not responsible for the ensuing processing of data by third-party providers. The companies responsible provide information on data processing in their respective privacy policies.

Where do we store the data?


Please note that our companies and our trusted partners and service providers are located around the world. For the purposes explained in this Privacy Policy, we store and process any non-personal data we collect in different jurisdictions.

Personal Data may be maintained, processed and stored in the United States, Ireland, South Korea, Taiwan, Israel and to the extent necessary for the proper provision of our Services and/or as required by law (as further explained below) in other jurisdictions.

How long will the data be retained?


Please note that we will retain the data we collect for as long as necessary to provide our services, to comply with our legal and contractual obligations to you, to resolve disputes, and to enforce our agreements. We may correct, amend or delete inaccurate or incomplete data at any time at our sole discretion.

How do we protect the data?


The hosting service for our digital assets provides us with the online platform through which we can offer you our services. Your data can be stored via our hosting provider's data storage, databases and general applications. It stores your data on secure servers behind a firewall and it provides secure HTTPS access to most areas of its services.

Notwithstanding the measures and efforts taken by us and our hosting provider, we cannot and do not guarantee absolute protection and security of the data you upload, post or otherwise disclose to us or others. For this reason, we ask that you establish strong passwords and, to the extent possible, do not provide us or others with confidential information the disclosure of which you believe would be material to you. f you believe disclosure could cause you significant or lasting harm. In addition, because e-mail and instant messaging are not considered secure forms of communication, we ask that you not share confidential information through either of these communication channels.

 

How do we handle minors?


The Services are not intended for users who have not reached the legal age of majority. We will not knowingly collect information from children. If you are under the legal age of majority, you should not download or use the Services or provide any information to us.

We reserve the right to request proof of age at any time so that we can verify whether minors are using our Services. In the event that we become aware that a minor is using our Services, we may prohibit such users from accessing our Services and block them, and we may delete any information we hold about such user. What are your rights?


Right to Information
You have the right to request confirmation as to whether your personal data are processed, and if so, which specific data are processed and for what purpose(s) (Art. 15 GDPR).

Rectification
You have the right to demand that inaccurate personal data be rectified without undue delay. Furthermore, in consideration of the processing purpose(s), you have the right to demand that incomplete personal data be completed (Art. 16 GDPR).

Right to Erasure
Once your user relationship has been terminated and the legal retention periods pursuant to tax and commercial law have expired, all personal data will be erased, unless you have expressly consented to the further use of such data with regard to your customer account. You may demand the erasure of your data at any time pursuant to Art. 17 GDPR if the statutory retention periods are not affected thereby and if the data are no longer required for performing contracts.

Right to Restriction of Processing
You have the right to demand that the processing of your personal data be restricted if one of the criteria pursuant to Art. 18 GDPR is met.

Right of Data Portability
You have the right to receive the personal data you have provided in a structured, commonly used, and machine-readable format, and you have the right to transmit such data to another responsible party without hindrance from us, provided the requirements pursuant to Art. 20 GDPR are met.

Right to Object
Pursuant to Art. 21 GDPR, you have the right to object to the processing of your personal data pursuant to Art. 6 para 1 lit. e) or lit. f) GDPR at any time on grounds relating to your particular situation.

Revocation
You may informally revoke your consent to the use of your data at any time with future effect (Art. 7 para. 3 GDPR). As the case may be, you may no longer use our services / may no longer use our services to the full extent.

Right to Lodge a Complaint
You have the right to lodge a complaint with a supervisory authority – without prejudice to any other administrative or judicial remedy – and may in particular do so in the country where you habitually reside or the place of the alleged infringement if you are of the opinion that our processing of your personal data constitutes a violation of data privacy laws (Art. 77 GDPR).

About updates or changes


We may revise this Privacy Policy from time to time in our sole discretion, and the version posted on the Site will always be current (see the "Status" statement). We encourage you to periodically review this Privacy Policy for changes. In the event of material changes, we will post a notice to that effect on our Website. Your continued use of the Services after we have posted a notice of changes on our Website will constitute your acknowledgement and consent to the changes in the Privacy Policy and your agreement to be bound by the terms of those changes.
